1. Who you are agreeing with
AnyGraide is run by ANYGRAIDE WEBSITE APPLICATION SERVICES, a sole proprietorship registered with the Department of Trade and Industry, Business Name No. 8316133, with its place of business at Fisheries Ave, Zone 2, Barangay Zone 2, City of Talisay, Negros Occidental. Its proprietor is Andrew Joseph Prudente Weber.
In these Terms, "AnyGraide", "we" and "us" mean that business. "You" and "your" mean the teacher who holds the account.

2. What these Terms cover
These Terms are the agreement between you and AnyGraide for your use of the AnyGraide website and everything it does. Our Privacy Notice and our Billing and Refund Terms are part of this agreement. Where one of those says something more specific than these Terms, the more specific document governs.
By making an account you accept these Terms. If you do not accept them, do not make an account.
3. Who may use AnyGraide
AnyGraide is built for teachers. You may make an account if you are at least 18 years old and you teach, or are preparing to teach, a class.
The account is yours personally. Keep your password to yourself, and tell us promptly if you think someone else has it. You are responsible for what is done through your account.
4. What AnyGraide does, and what it does not do
AnyGraide has two sides.
Making tests. You upload your syllabus and your own teaching materials. AnyGraide reads them and builds a printable test with an answer key, drawn from the part of the course you are actually teaching.
Checking papers. AnyGraide reads scanned or photographed student papers, proposes a mark for each answer, and shows you why. This side is part of your account but is not sold as part of the paid test-making package.
Two things follow from how it works, and you should read them before you rely on it.
AnyGraide proposes; you decide. Every question it writes and every mark it suggests is a draft for a teacher to check. Nothing is final until you say it is. The test you give your class, and the grade you record for a student, are your professional judgement and your responsibility.
It can be wrong. AnyGraide uses artificial intelligence. Artificial intelligence misreads handwriting, mistakes one symbol for another, and occasionally writes a question that does not hold up. We work to reduce that. We do not promise it will not happen.
5. Your materials stay yours
You keep ownership of everything you upload — your syllabus, your handouts, your modules, your reviewers, your own exam papers — and of every test AnyGraide builds for you from them.
You give us permission to store your materials and to process them, including by sending their text to the services listed in our Privacy Notice, for one purpose only: running AnyGraide for you. That permission lasts while your account exists and ends when you delete the material or close the account.
What we will not do with your materials:
- We will not sell them, licence them, or hand them to another company for its own purposes.
- We will not put them into the shared question bank that other teachers draw from. Your uploads live in your own material bank, kept separate in the system itself.
- We will not use them to train a model of our own without asking you first and getting a clear yes.
Two things are worth saying plainly, because they are true and you should know them.
- When you make a test from a file you upload, the file is read inside your own browser. Only the text AnyGraide needs is sent to us. The file itself never leaves your computer.
- When you make a test from a textbook already in AnyGraide's library, the questions written for you are added to our shared question bank and may be used again for another teacher working on the same chapter. Those questions are written from the shared textbook, not from anything you uploaded. Your own material never enters that bank.
6. Uploading work that someone else wrote
Most of what a teacher uploads was written by someone else. You are the one who decides to upload it, and by uploading it you tell us that you are allowed to — because you own it, because your school licensed it, because the copyright owner permitted it, or because Philippine copyright law allows what you are doing with it.
Philippine law does allow a good deal of educational use. Section 185 of the Intellectual Property Code treats as fair use the use of a work for "teaching including limited number of copies for classroom use", and section 184.1(e) allows a work to be used by way of illustration for teaching. Both are limited: section 184.2 says no exception may be read to conflict with the normal exploitation of the work or unreasonably prejudice the owner's legitimate interests, and section 187 does not permit copying an entire book.
We do not check what you upload against any copyright database, and we do not advise you on whether a particular use is permitted. That judgement is yours.
If a copyright owner believes their work is on AnyGraide without permission, write to andrewjosephpweber@gmail.com identifying the work, where it appears, and your authority to act. We will look at it, tell the teacher concerned, and where the complaint is well founded we will remove the material. A teacher whose uploads are repeatedly and plainly infringing may lose the account.
7. Your students' information
This is the part that matters most, so it is written plainly.
When you put your class list into AnyGraide, or scan your students' papers, you are handling your students' personal information. Under the Data Privacy Act of 2012, you and your school decide what happens to that information. AnyGraide handles it for you, on your instructions. In the language of the Act, you and your school are the personal information controller and we are your personal information processor.
That means:
- You need a lawful basis for putting student information into AnyGraide. Normally that comes from your school. Before you upload a class list or a stack of papers, make sure your school knows and agrees.
- Your school can have a written agreement with us. We have one ready — ask and we will send it. The Data Privacy Act's implementing rules require a written agreement between a controller and its processor, so this is not a formality.
- We process student information only to do the job you asked for — reading a paper, matching it to a name, proposing a mark, showing a student their marked work — and for nothing else.
- We will help you answer your students. If a student asks what is held about them, asks for a correction, or asks for erasure, tell us and we will do our part.
- We will not use student papers to improve how AnyGraide reads handwriting unless you and your school have agreed to it, separately and clearly.
Our Privacy Notice sets out everything we hold, for how long, and who else sees it.
8. What you may not do
Do not use AnyGraide to break the law or someone else's rights. In particular, do not:
- upload material you have no right to upload;
- upload another person's personal information without a lawful basis for doing so;
- try to reach another teacher's account, materials or students;
- resell or rebrand AnyGraide, or run it on behalf of other teachers as a service;
- attack, overload or probe the service, or work around its limits by automation;
- use it to produce anything unlawful.
9. Plans, prices and payment
Our plans, what each includes, how a term runs, and what happens when you stop paying are in the Billing and Refund Terms, which form part of this agreement.
Two commitments belong here as well, because they are promises about the service and not only about money.
Stopping payment never deletes your work. If a paid term ends and you do not buy another, every test you have made stays in your account. You can open it, print it and download it. What changes is how many you may keep in your active library going forward.
You can take your work with you. Every test AnyGraide makes downloads as a Word, PowerPoint or PDF file, with its answer key, on any plan including the free one.
10. Availability and changes to the service
AnyGraide is early software, actively being built. We do not promise it will be available at all times, and we may change, add or withdraw features.
Where a change takes away something you are paying for, we will tell you before it happens, and if you have paid for a term you can no longer use as sold, we will refund the unused part.
We may take the service down for maintenance. We will keep that short and, where we can plan it, we will tell you first.
11. Ending the agreement
You may stop using AnyGraide at any time, and you can close your account yourself from Settings. Closing it deletes your classes, your students, their submissions, your materials and your tests. Download anything you want to keep first — it cannot be undone. Our Privacy Notice says exactly what closing an account does not reach, and how to ask us to clear those too.
We may suspend or close your account if you break these Terms in a way that matters, if the law requires it, or if we stop offering the service. Except where the breach is serious or we have no choice, we will warn you first and give you a chance to put it right. If we close your account for a reason that is not your fault, we refund the unused part of any term you have paid for.
If we ever shut AnyGraide down, we will give you at least 60 days' notice and keep your downloads working for that whole period.
12. What we are responsible for
We will provide AnyGraide with reasonable care and skill. We do not promise the questions it writes are correct, that the marks it proposes are right, or that it suits any particular syllabus, school or examiner.
Nothing in these Terms takes away a right you have under the Consumer Act of the Philippines, the Data Privacy Act, the Internet Transactions Act, or any other law that cannot be contracted out of. In particular, we do not ask you to give up your right to complain to the National Privacy Commission or to the Department of Trade and Industry, and any attempt to do so would be void.
Subject to that, and to the fullest extent the law allows: we are not liable for lost profits, lost opportunity, or loss arising from grades you recorded or tests you gave without checking them; and our total liability to you in any twelve-month period is limited to what you paid us in that period.
13. If something goes wrong — complaints
Write to andrewjosephpweber@gmail.com. We will acknowledge within two working days and give you a real answer as quickly as we can.
Under the Internet Transactions Act you must use this internal complaints route before going to a court or an agency, and it is treated as exhausted if your complaint is still unresolved seven calendar days after you file it. After that you may take the matter to the Department of Trade and Industry, and for anything about personal data to the National Privacy Commission.
You have two years from when a claim arises to bring it.
14. Changes to these Terms
We may change these Terms. If a change matters to you, we will email you at least 30 days before it takes effect, and if you do not accept it you may close your account and take a refund of any unused paid term. Changes that only correct wording take effect when we publish them.

15. Which law, and where disputes go
These Terms are governed by the laws of the Republic of the Philippines. Court proceedings go to the courts of Negros Occidental, without taking away any right you have as a consumer to bring a claim where you live or before the Department of Trade and Industry.
If any part of these Terms is unenforceable, the rest still stands.
